DMCA Policy
fixArh magazine respects the intellectual property rights of others. We expect our users to do the same. This policy outlines our procedures for addressing alleged copyright infringement under the Digital Millennium Copyright Act (DMCA).
We are committed to protecting creators’ rights concerning articles, images, and other content published on our site. Unauthorized use of copyrighted material will result in removal according to DMCA guidelines.
Filing a DMCA Takedown Notice
If you believe content on fixarh.com infringes your copyright, please send a written DMCA takedown notice to our designated agent. Your notice must include the following information:
- A physical or electronic signature of a person authorized to act on behalf of the copyright owner.
- Identification of the copyrighted work you claim has been infringed. This should be specific, such as a URL or a title and publication date.
- Identification of the material you claim is infringing and needs to be removed or access disabled. Please include the URL(s) where the infringing material appears on fixarh.com.
- Sufficient information to allow us to contact you, such as an address, telephone number, and email address.
- A statement that you have a good faith belief the use of the material is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notice is accurate, and under penalty of perjury, that you are authorized to act on behalf of the copyright owner.
We will review all complete notices promptly. Valid notices typically lead to the removal of the identified content.
DMCA Counter-Notification Process
If you believe your content was removed in error or by mistake, you may send a DMCA counter-notification. This allows you to challenge the removal of your material. Your counter-notification must contain the following:
- Your physical or electronic signature.
- Identification of the material that has been removed or to which access has been disabled, and the location where the material appeared before its removal or disabling.
- Your name, address, and telephone number.
- A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or if outside the United States, for any judicial district in which fixArh magazine may be found). You must also accept service of process from the person who provided the original DMCA notification or an agent of such person.
- A statement under penalty of perjury that you have a good faith belief the material was removed or disabled as a result of mistake or misidentification.
Upon receiving a valid counter-notification, we will forward a copy to the original complaining party. We will then wait 10 business days. If the copyright owner does not file a court action seeking a court order to restrain the user from engaging in infringing activity, we may restore the removed content after this period.
